RETURN POLICY

1. Scope
This right of withdrawal applies to orders placed by consumers, i.e. natural persons who conclude the contract for purposes which cannot be attributed to their professional or commercial activity.
For consumers habitually resident in the EU/EEA or in the United Kingdom who order products via means of distance communication (e.g. online shop, e-mail, telephone), the right of withdrawal set out below applies, unless a statutory exception applies (section 3).
For orders with a delivery address in Switzerland or the Principality of Liechtenstein, there is no statutory right of withdrawal; our General Terms and Conditions apply.
2. Withdrawal Notice
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you, or a third party named by you who is not the carrier, take(s) possession of the goods.
To exercise your right of withdrawal, you must inform us:

of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an e-mail). You may use the model withdrawal form in section 7, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
3. Statutory Exceptions (No Right of Withdrawal)
The right of withdrawal does not apply to contracts for:
- goods that are liable to deteriorate or expire rapidly (this includes our fresh chocolate and confectionery products);
- goods that are not prefabricated and are made on the basis of an individual choice or decision by the consumer, or that are clearly personalised (e.g. individually composed assortments, personalised products, custom-made items);
- sealed goods which are not suitable for return for reasons of health protection or hygiene, where the seal has been removed after delivery.
As our range consists predominantly of fresh or perishable foodstuffs, the right of withdrawal will in practice mainly apply to non-perishable, non-personalised items (e.g. gift articles not containing food).
4. Consequences of Withdrawal
If you validly withdraw from this contract, we shall reimburse all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we received your notice of withdrawal. We will carry out the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earlier.
Return and costs: You must send back the goods without undue delay and in any event no later than 14 days from the day on which you notified us of your withdrawal, to the return address in section 6. The deadline is met if you send the goods before the 14-day period has expired. You bear the direct cost of returning the goods, unless the error lies with us (e.g. wrong delivery or defective goods).
Compensation for diminished value: You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
5. Defects, Transport Damage and Warranty
Your statutory warranty rights remain unaffected by this right of withdrawal. Should products arrive damaged or be defective, please notify us as soon as possible — ideally within 5 working days of receipt — by e-mail to orders@thomasmuller.ch. Please retain the packaging and the goods and attach photos to your message so that we can document the damage and quickly arrange a replacement or refund. Reporting promptly facilitates processing but is not a precondition for your statutory rights as a consumer.
